MonkeyRiot Terms of Use
Effective date: November 3, 2026
These terms are an agreement between you and MonkeyRiot (Dan Tollett, sole proprietor), "we" or "us," for your use of the MonkeyRiot Android app. When you first open MonkeyRiot, and again when these terms change in an important way, the app asks you to tap I agree to these terms and our Privacy Policy. By tapping I agree, you accept these terms. If you don't agree, please don't use the app.
1. Important: MonkeyRiot is not a safety or emergency system
MonkeyRiot is not a fire alarm, smoke or carbon monoxide alarm, emergency alert system, or lockdown or active-shooter alert system. Do not use it for any of those purposes.
Alarms, bells and family or group pushes can be late, or not happen at all. Common causes include:
- a dead or low battery, or the phone being off,
- Do Not Disturb, silent mode, low volume or battery-saver settings,
- no internet connection, or delays in Google's push service,
- Android or phone-maker settings that stop apps in the background,
- Closing MonkeyRiot with "Force stop" or clearing its storage may cause your alarms to not ring until you open MonkeyRiot again.
- turned-off permissions, app updates, bugs, or outages at Google or Cloudflare.
Don't rely on MonkeyRiot for anything where a missed or late alarm could cause injury, illness, loss or damage, including medication timing, medical care, caring for a person at risk, safety at work or school, or travel connections. Use a dedicated, certified system for safety and emergencies, and check that your alarms work on your phone.
2. Who can use MonkeyRiot
Anyone can use MonkeyRiot's alarm clock without signing in; a parent or guardian who sets it up on a child's phone agrees to these terms for the child. Family and Groups need a Google sign-in and are only for people 13 and older; the app asks your age first and blocks sign-in for anyone under 13. If you're 13 to 17, a parent or guardian must review these terms and agree to them for you, and they are responsible for your use. If Google Play tells us you're a minor whose parent hasn't approved MonkeyRiot, Family and Groups won't be available and we won't enforce these terms against you.
3. Your account
Family and Groups use your Google account through Firebase. Keep your Google account secure. You're responsible for what happens under your account. You can sign out at any time, and you can delete your MonkeyRiot data with Delete my MonkeyRiot data in Settings › Family, or by emailing us (see Deleting your data). This doesn't affect your Google account.
4. Family and Groups
- Only set alarms for people who agreed to it. Another person can set alarms on your phone, or see your alarms, only if you allow it, and you can take that permission back by unlinking.
- Locked alarms: a person you allowed can lock an alarm they set on your phone so it can't be turned off from your phone while you're linked. You can always unlink to remove it.
- You're responsible for what you send: alarm labels, voice messages and group names. Don't send anything unlawful, harassing, threatening, hateful or sexually explicit, and don't record people without permission where the law requires it.
- Group organizers are responsible for the schedules they share and for inviting only people who want to join.
5. Acceptable use
Don't:
- use MonkeyRiot to harass, stalk, wake or disturb people who haven't agreed to it,
- try to access other people's data, get around the app's permissions or security, or overload our servers,
- copy, resell, or reverse-engineer the app, except where the law allows,
- use the app in breach of any law.
We may suspend or delete accounts that break these terms.
6. Your content
You keep ownership of what you create, such as recordings, labels and schedules. You give us permission to store, process and deliver it only as needed to run the app's features for you and the people you share with.
7. Our app
MonkeyRiot, its name, logo, tones and design belong to us. We give you a personal, non-transferable right to use the app on your devices under these terms and Google Play's terms. We may change, add or remove features, or stop offering the app.
8. Purchases
If MonkeyRiot or any part of it is sold, payment goes through Google Play under Google Play's terms, including its refund policy.
9. Third-party services
MonkeyRiot relies on Google Firebase, Google Play and Google Play services, and Cloudflare. Their availability is outside our control, and your use of them is also subject to their terms.
10. No warranty
To the fullest extent the law allows, MonkeyRiot is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, reliability, accuracy, or uninterrupted or error-free operation. We don't promise that any alarm, bell, push or voice message will play or arrive, or arrive on time.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss, injury or damage caused by a missed, late or wrong alarm, bell or push, or by relying on the app. Our total liability for all claims combined about the app is limited to the greater of the amount you paid for MonkeyRiot in the 12 months before the claim, or US $10.
Nothing in these terms limits or excludes our liability for fraud, for our gross negligence or willful misconduct, for death or personal injury caused by our negligence, or any other liability or consumer right that the law doesn't allow to be limited or excluded. Some places don't allow certain limits, so some of these may not apply to you.
12. Indemnity
If someone makes a claim against us because of how you used MonkeyRiot or what you sent through it, in breach of these terms, you agree to cover our reasonable costs from that claim, to the extent the law allows.
13. Ending use
You can stop using MonkeyRiot at any time: tap Delete my MonkeyRiot data (Settings › Family) or email us, then uninstall the app. We may end or suspend your access if you break these terms or if we stop offering the app. Sections 1, 6 (as needed to delete your content), 10 to 14, and 16 continue after that.
14. Governing law
These terms are governed by the laws of Guam and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be handled in the Superior Court of Guam or, where it has jurisdiction, the District Court of Guam, unless the law where you live gives you the right to bring it in your local courts or to rely on your local consumer laws. There is no arbitration requirement.
15. Changes to these terms
We may update these terms. For important changes, we'll tell you in the app at least 30 days before they take effect, update the effective date above, and give any notice to app stores the law requires. Changes won't apply to disputes that started before the change. If you don't agree, stop using the app and delete your MonkeyRiot data; if you keep using it after the change takes effect, the new terms apply.
16. Google is not a party
Google is not a party to these terms and isn't responsible for MonkeyRiot. Google Play's terms also apply to how you download it.
